Prosecutors Close Rape Case Against Yuval Vilner Due to Insufficient Evidence

The State Prosecutor's Office has informed Shi-Li Atari that it intends to close the case against Yuval Vilner, citing a lack of sufficient evidence to bring him to trial. This decision comes approximately a year and a half after the case was initially closed and then reopened following an appeal by Atari.

Atari, who accused Vilner of rape allegedly occurring 15 years prior, expressed her disappointment, stating that the closure was not due to a lack of evidence of the assault or proof of Vilner's innocence, but rather the inability to gather enough evidence for a trial after so many years. She criticized the legal system, suggesting it allows perpetrators to escape justice due to loopholes and the passage of time.

Sources within the prosecution explained that Atari's and another complainant's testimonies were significantly different and did not corroborate each other. Atari's complaint was filed 11 years after the alleged incident, and her testimony was affected by memory gaps due to her condition at the time. While her roommate's account of finding her unconscious was considered strong, investigators struggled to establish a clear timeline of events and the exact duration between the alleged assault and her discovery.

The prosecution noted that evidence of date rape drugs diminishes quickly, and mobile phone location data was unavailable after so many years, making it difficult to build a case. Despite not discrediting Atari's account, the lack of concrete evidence posed a significant hurdle.

Atari had filed her complaint in 2022, leading to an investigation and a gag order on Vilner's name, which was later lifted when his identity became public. The case was initially closed in March 2025, but Atari's appeal led to its reopening. She highlighted the challenges faced, including attempts by the suspect's lawyer to obtain affidavits from potential witnesses before they were questioned by investigators.

Supporters of Atari and another complainant, Naama Shahar, expressed solidarity, emphasizing the profound psychological damage caused by Vilner and criticizing the law enforcement system for its perceived failures. They hope Vilner will still face consequences for his alleged actions.
