Israeli Judge Demands Concrete Evidence in Fraudulent Insurance Claim Case

In the first case, a dispute between a plaintiff and the Rishon LeZion Municipality over a vehicle impoundment, Nissim-Lev struggled to determine if the municipality had legally served the plaintiff with a pre-impoundment warning. The court was unable to confirm delivery of the notice, with postal tracking information being obscured. Nissim-Lev emphasized that the small claims court's role is to examine the process of impoundment, not the legality of the impoundment itself, and advised the plaintiff to pursue a new claim if she wished to challenge the delivery process further.
In a second case involving an insurance claim against the Phoenix company, the plaintiff, who suffered a stroke affecting his memory, claimed his home was burglarized. The insurance company alleged fraud. Nissim-Lev expressed skepticism about the company's evidence of fraud, questioning the investigator's reliance on the plaintiff's statements to his ex-partner and the lack of thorough investigation, such as checking police reports or seeking forensic evidence. She stated that proving fraud carries a heavy burden and requires "findings that raise the eyebrows," indicating her reluctance to rule on fraud without substantial proof.
Nissim-Lev urged both parties in the insurance case to negotiate, suggesting that the plaintiff accept the appraiser's report, which valued the stolen sunglasses at 1,500 shekels, rather than the 5,000 shekels claimed. She noted that proving the original cost and depreciation would be the plaintiff's responsibility. Ultimately, the parties reached an agreement for 10,000 shekels, a reduction from the initial 15,000 shekel claim.
