New Israeli Construction Safety Regulations Shift Responsibility to Developers Starting October

In mid-October 2026, new safety regulations for construction sites in Israel will take effect, marking a significant shift in responsibility by holding developers directly accountable for site safety for the first time. The reform, approved after years of deliberation by the Knesset's Labor and Welfare Committee, transfers the primary responsibility from site managers to those commissioning, funding, and executing the work.

Since the beginning of 2026, there have been 393 construction site accidents resulting in 29 fatalities, according to the Ko LaOved organization. The new regulations aim to reduce these numbers by expanding the circle of safety responsibility and introducing two new roles: a safety inspector appointed by the developer to conduct periodic site inspections and report deficiencies, and a site manager for large projects responsible for implementing safety plans and managing risks.

The rules require that construction work cannot commence without a formal safety plan, allocation of necessary resources, and appointment of relevant personnel. They also mandate clear timelines for addressing unacceptable risks and, in some cases, work stoppages. Additionally, the regulations establish certification requirements for safety roles and require registration of site managers in a dedicated registry.

These changes will also affect contractual relationships between developers and contractors, who will need to include detailed safety responsibilities and resource allocations in their agreements. Contractors are expected to seek compensation for additional costs arising from compliance. Insurance companies may tighten coverage conditions, demanding proof of adherence to the new rules, with potential coverage reductions or claim denials if violations occur.

Attorney Shira Bas Rosen of Professor Bein & Co. Law Firm explains that the regulations require a deep organizational and operational shift in safety management, extending from company leadership to site workers. Former Ministry of Safety and Health CEO Dr. Miki Winkler highlights that developers have not traditionally been involved in site safety, but the new rules require active developer engagement and establishment of monitoring mechanisms beyond merely appointing a safety inspector.

Estimated annual compliance costs for developers could reach approximately 250,000 shekels, varying by project size. Some developers are already adapting by revising contracts and hiring safety inspectors. Bas Rosen notes that the regulations set minimum standards, leaving developers to build tailored safety systems suited to their operations, warning that minimal compliance may be insufficient in the event of safety incidents.
