Tel Aviv District Court Judge Shmuel Melamed sharply criticized the Israeli prosecution for its consistent opposition to mediation in criminal cases. He noted that the prosecution has recently been sending unjustified objections to mediation requests, which significantly burdens the court's schedule and forces many cases to proceed to the evidentiary phase. This criticism followed the prosecution's refusal to allow mediation in a case involving a defendant accused of stabbing two victims. Judge Melamed emphasized that the most serious consequence of this approach is the harm to the public interest, as artificially prolonging cases delays sentencing by years, reducing its deterrent effect. He concluded that the prosecution alone is responsible for the resulting court congestion, as it fails to take sufficient steps to alleviate it.

In response, the prosecution stated that the defendant stabbed his victims multiple times across various body parts, constituting a severe violent crime supported by strong evidence. According to the Attorney General's policy, mediation is inappropriate in such circumstances, and the interest in reducing court workload is outweighed by the severity of the offense, its circumstances, and the need to fully enforce the law.
