Israeli Court Orders Adult Son With Special Needs to Move to Hostel Amid Parental Divorce Dispute

After many years of marriage, an Israeli couple decided to divorce. Their adult children had long left home except for one 30-year-old son with special needs who remained dependent on his parents and living with them. While the couple reached agreements on most financial matters during the divorce process, a major dispute arose over where their son should live post-divorce.

The mother argued that it was time for her son to move to a specialized hostel that could provide professional care, social life, and round-the-clock support. She cited her own aging, relocation, and difficulty in continuing daily care as reasons. The father, however, believed the son’s natural place was at home with family, fearing the drastic change would harm him. The siblings declined to take sides but requested not to be burdened with the decision.

Recognizing the complexity, the court appointed a legal guardian to represent the son’s interests and a court expert psychologist specializing in autism to assess his condition and needs. After reviewing all professional opinions, the court ruled in favor of the mother’s position, ordering the son’s transfer to the hostel. The court reasoned that moving between two elderly parents’ homes would harm the son’s well-being and that the parents, despite their dedication, could not fully meet his needs as the hostel could.

This case highlights that in family disputes involving adult children with special needs, courts prioritize the child’s welfare over parental claims. Both parents acted out of love, but the court’s role is to determine the best care arrangement, even when the child is an adult.
