Holon Appeals Committee Reviews Dispute Over Balcony Expansion Affecting Sukkah Construction

A rare dispute between neighbors in a residential building in Holon has reached the District Appeals Committee for Planning and Construction. The conflict began when residents sought to expand their balconies by adding "stepped balconies." One neighbor opposed the plan, arguing that the expansion of the balcony above her apartment would block her ability to build a kosher sukkah on her own balcony during the Sukkot holiday. The Holon municipality sided with her and restricted the balcony expansion above her unit to preserve her sukkah-building rights.

However, other residents challenged the municipality's decision and appealed to the committee chairman, Attorney Eyal Iluz, requesting permission to contest the ruling. In an unusual move, Iluz allowed the appeal to proceed and raised a fundamental question about whether the balconies in the building are officially defined as "sukkah balconies," a classification that could influence the ruling.

The committee must now decide if the Holon municipality had the authority to impose planning restrictions to preserve sukkah construction rights or if the decision exceeded its powers and infringed on other residents' rights to expand their balconies. The outcome is expected to set a precedent for similar cases where building rights conflict with religious practices, especially in multi-unit buildings.
