Israeli Court Orders Defense Ministry to Compensate Reservist for Emergency Recall Flight Costs

The Tel Aviv Small Claims Court ruled in favor of a reserve officer, ranked Major (Res.), who sued the Defense Ministry's Human Resources Division for reimbursement of flight expenses incurred when he was urgently recalled to service under an emergency order (Order 8) in June 2025. The officer was abroad in the Czech Republic at the time and had to undertake a complex journey involving flights from Prague to London, then Larnaca, and finally Aqaba, followed by a bus ride to central Israel to report for duty.

The Defense Ministry initially refused to cover the flight costs, demanding proof from a senior officer (Colonel or above) that the reservist's service was necessary, citing internal procedures of the Defense Ministry’s Assistance Fund. The court criticized this stance, noting that the state required immediate compliance with the emergency order but then paradoxically demanded justification for the reservist’s obedience.

Judge Aviyam Barkai emphasized that the reservist acted lawfully and went to great lengths to comply with the emergency summons. The court found that the Defense Ministry’s refusal to reimburse the officer contradicted the Assistance Fund’s clear regulations, which guarantee compensation of up to 5,000 shekels for such flight expenses. The Ministry’s additional demands for proof of necessity were not stipulated in the fund’s rules and were deemed an unjustified breach of the state's commitment.

The court ordered the Defense Ministry to pay the reservist 5,000 shekels as the maximum compensation allowed under the fund, plus 1,000 shekels for legal expenses, along with statutory linkage and interest. The remaining 659 shekels in expenses above the fund’s cap will be reviewed by the Assistance Fund’s exceptions committee as per the Ministry’s commitment. The ruling also condemned the Ministry’s dismissive handling of the claim and failure to properly address the exceptions committee process.
