Legal Advisors in Israeli Knesset Dominate and Restrict Legislative Work, New Documentary Reveals
A new documentary by Avraham Hasson exposes how the legal advisory body in the Israeli Knesset has shifted from a professional support role to a dominant political actor that shapes policy and restricts lawmakers. Traditionally, legal advisors were meant to assist elected officials by providing professional guidance to translate policy into proper legislation. However, the film reveals that today, the legal advisors effectively control the legislative process, requiring near-total approval for any bill to proceed.
This gradual takeover of authority by the legal advisors was not formalized by law but emerged through daily practices, binding legal opinions, and systemic alignment, creating a reality where legislation depends heavily on their consent. Policy researcher Noga Arbel describes the power imbalance as intimidating, stating that any Knesset member who challenges the legal advisors risks losing their ability to serve effectively.
Knesset members express fear of direct confrontation with the legal advisory system, which they see as essential yet restrictive. MK Galit Distel Atbaryan highlights the absolute dependence on legal advice for passing legislation, while noting the high cost of opposing the legal advisors, which can jeopardize a lawmaker’s legislative agenda. This fear fosters compliance that undermines elected officials’ ability to fulfill their electoral promises.
Despite criticism, the Knesset’s legal advisor, Attorney Shagit Afik, defends her role as a necessary protector of lawmakers’ immunity and freedom of expression. She rejects the harsh critiques and calls for mutual respect among branches of government. Nonetheless, many lawmakers feel that this "respect" has effectively become submission to the legal advisors’ dictates, significantly limiting legislative independence.
