Knesset Legal Advisor Flags Procedural Flaws in Security Service Arrests Law to Supreme Court

The Knesset's legal advisor submitted an official response to the Supreme Court regarding petitions against the Security Service Law, also known as the Arrests Law. The document highlights significant procedural defects in the legislation process, noting that the temporary order exceeded the scope of the original bill and introduced a "new subject." It also argues that the legislative process failed to meet the high standards required given the post-October 7 security context and evolving IDF needs.

The response details the complex challenges the Knesset faced in balancing enforcement and arrests with legal scrutiny. Supporters of the temporary order, including Knesset members and the government secretary, justified it as a necessary step to prevent escalation. The government secretary warned that mass arrests of yeshiva students cause deep distress in the ultra-Orthodox community and risk alienating them further, potentially leading to internal conflict.

Opposing views from defense officials and the IDF Chief of Staff emphasized the operational importance of enforcement tools. The Chief of Staff warned that the proposal incentivizes draft evasion by granting immunity from prosecution, conflicting with the IDF's needs.

The issue of drafting yeshiva students has been contentious in Israel for decades, with Supreme Court rulings mandating equal draft enforcement. Following these rulings, the military began enforcing orders against draft evaders in the ultra-Orthodox community. The government applied legislative continuity to an older government bill after extensive committee discussions, during which sensitive topics like women's integration in the IDF and national service alternatives were dropped.
