Netanyahu and Elovitch Lawyers Seek Clarification on Prosecutor's Stance Regarding Bribery Charge in Case 4000

The defense attorneys for Benjamin Netanyahu and Shaul Elovitch, Amit Hadad and Jacques Chen, submitted a request to the court on Wednesday seeking clarification from Attorney General Gali Baharav-Miara about her position on the judges' recommendation to drop the bribery charge in Case 4000. This request follows Judge Rivka Friedman-Feldman's recent remarks highlighting difficulties in proving the bribery allegation against Netanyahu. In a hearing last month, Friedman-Feldman stated that despite not initially planning to say so, after hearing Netanyahu's testimony, the judges' June 2023 stance on the issue remains unchanged, noting significant challenges in substantiating the bribery offense. Earlier in 2023, the judges had suggested the prosecution consider withdrawing the bribery charge due to these evidentiary challenges.

Hadad and Chen emphasized in their letter that the judges' recommendation carries substantial legal and procedural implications, particularly affecting the defense's trial preparation. They cited a July 20, 2023 court decision which noted the absence of a clear plan from the parties to continue proceedings under the current format, underscoring the importance of the Attorney General's timely response. The lawyers requested that Baharav-Miara clarify her position before the next scheduled hearing on September 6, warning that any delay would hinder effective preparation for the defense.

The case remains highly significant as Netanyahu, during his testimony, accused the prosecution of misleading him and setting a trap, underscoring the contentious nature of the bribery charge and the ongoing legal debate surrounding it.
