Class Action Filed Against Space Fitness Chain for Sending Ads After Subscription Cancellation
A class action lawsuit has been filed against Space Fitness Clubs in the Kfar Saba Magistrate's Court, alleging the company continued sending advertising messages to customers after they canceled their subscriptions, violating Israel's Communications Law. The plaintiff, Amit Worgapt, claims that after purchasing and then canceling a monthly membership, Space sent him three marketing messages encouraging him to rejoin, plus an additional message inviting him to participate in a survey for a chance to win a 1,500 shekel prize.
The lawsuit asserts that these messages were sent via SMS and WhatsApp without consent, often lacked the required "advertisement" label, and did not provide a proper opt-out option as mandated by law. Some WhatsApp messages also allegedly failed to include full advertiser details. The plaintiff further claims that in some cases, the only opt-out method was clicking a link, which does not meet legal standards.
This is not the first time such allegations have been made against Space or its affiliated companies. A previous class action against another company in the Space group ended in a settlement where the chain promised to improve compliance with advertising laws. Despite that, the plaintiff alleges violations have continued.
The lawsuit seeks recognition as a class action on behalf of all individuals who received unsolicited advertising messages from Space in the past three years or who requested to stop receiving them. It requests the court to order Space to cease the alleged practices and to award compensation of 100 shekels per message to class members. The total claim is estimated at under 2.5 million shekels. As of now, these are the plaintiff's claims only; the court has yet to rule and Space has not filed a defense.
