Consumer Rights in Israel: When Faulty Products Warrant Full Refunds
Israeli consumer protection laws provide clear recourse for faulty new electronics and appliances, distinguishing between products damaged upon arrival and those that malfunction after initial use. For items priced over 150 shekels, a one-year warranty covers free repairs with new parts, including shipping to and from the service center, at the manufacturer's expense. However, if a product is defective or not as promised upon delivery, consumers are entitled to cancel the transaction without penalty, receive a full refund, and have the item collected by the seller. This right is crucial, as agreeing to a technician's visit can shift the process to repairs, giving the manufacturer more control over time and resolution.
Recent court cases highlight these rights. In one instance, a washing machine costing 1,590 shekels, which required four technician visits and a lab test, resulted in a full refund of 3,489 shekels, including compensation, awarded by a small claims court. Another case involved a 599 shekel television that arrived with a defect, leading to a full refund and additional expenses. Consumers are advised to document any issues immediately upon receipt, ideally with photos and written notification to the seller within a reasonable timeframe.
When a product malfunctions after being used, it falls under the 2006 service regulations. Repairs are typically expected within 10 days of the item reaching a service center, with specific timelines for more distant locations. If a repair fails, consumers are entitled to either an identical replacement product or a full refund, with the manufacturer choosing which option to provide. However, the consumer can insist on a refund if they prefer.
Beyond the initial warranty period, manufacturers are obligated to maintain spare parts for a specified duration: two years for products over 300 shekels, and seven years for major appliances like refrigerators, ovens, washing machines, dishwashers, televisions, and air conditioners. Refusal to repair due to a missing part within these extended periods violates regulations. The Consumer Protection Authority received 44,612 complaints in 2024, with an average resolution time of 135 days, underscoring the importance of small claims courts for individual consumer disputes, which can handle claims up to 39,900 shekels.
