Unusual Intellectual Property Deal: Social Media Clarification Alongside Symbolic Payment
An unprecedented intellectual property settlement has been reached in Israel, involving a recorded clarification to be broadcast on social media for six months by a former employee accused of infringing on protected rights. The plaintiff company, D.N.D. Technica, the exclusive importer of the German cosmetics brand Dr. Christine Schrammek, will receive a symbolic financial compensation of 120,000 shekels, a fraction of the 3 million shekels initially sought. The initial court fee alone was 37,500 shekels.
D.N.D. Technica had sued cosmetologist Galia Israeli, alleging she misused professional secrets, training, and commercial knowledge gained during her employment. After her departure under "very negative circumstances," Israeli allegedly established her own business and sold counterfeit products mimicking Dr. Schrammek's flagship "Green Peel" series. D.N.D. Technica claimed Israeli's products used identical or misleadingly similar names, copied ingredient lists, and user instructions, aiming to deceive consumers into believing they were purchasing authentic products. The company also warned of potential public health risks.
Israeli vehemently denied counterfeiting or selling "pirate" cosmetics, stating she purchased products from suppliers and used them in her treatments and training under her own name. She asserted she did not sign a non-compete agreement and was not trying to impersonate the plaintiff or Dr. Schrammek. She argued the lawsuit's sum was excessive and intended to intimidate, constituting a misuse of legal proceedings to stifle competition and violate freedom of occupation.
Under the agreement, brokered by attorney Avi Ordo, Israeli does not admit to the alleged infringements but acknowledges that a misleading impression may have been created. She committed to refraining from any infringement, ceasing to use Dr. Schrammek's trademarks or similar confusing signs, and preventing any impression that she markets Dr. Schrammek products. She will destroy and cease using Dr. Schrammek training and marketing materials and remove related mentions from social media.
Israeli must record and publish a video clarification on her main social media accounts for six months, re-disseminating it every three weeks. The message must be clear and unequivocal, though not necessarily verbatim from the agreed text. D.N.D. Technica is permitted to publish the clarification on its website and social media for two months.
