US Urges NATO Allies to Dismantle International Criminal Court

The Trump administration is intensifying its efforts against the International Criminal Court (ICC) in The Hague, reportedly urging NATO allies to join a campaign to dismantle the court's capabilities. According to Politico, Washington distributed a document calling on member states to withdraw from the Rome Statute and cease support for the ICC. The US envoy to NATO, Matthew Whitaker, allegedly warned allies during a closed meeting in Brussels that the US would "closely monitor who stands with America."

The US document outlined a plan for the "systematic dismantling" of the ICC's abilities, demanding that Rome Statute signatories take immediate steps toward withdrawal. It also called on allies to reassess the threat the court poses to their nations, publicly condemn any overreach, and halt material support. "Let's end the pretense of the ICC once and for all," the document stated.

However, the US initiative has met resistance from some European nations. France and the Netherlands have publicly defended the ICC, affirming their unwavering support and stating they have no intention of joining the US-led effort. One diplomat present at the NATO meeting described the US message as "quite shocking" and another as "disappointing."

The US campaign extends beyond NATO, with American envoys raising these demands in direct talks with European governments. This effort is a continuation of a policy announced in July, when Secretary of State Marco Rubio stated the US would develop a comprehensive governmental response to systematically undermine the court's operational capacity, potentially including further sanctions and entry restrictions into the US.

The conflict between Washington and the ICC has escalated due to the court's actions against Israel and the US, including sanctions imposed on ICC officials over investigations into Israeli actions and US activities in Afghanistan. The US is not a party to the Rome Statute. Recently, the current and former presidents of the ICC Assembly of States Parties issued a rare statement condemning attempts to isolate the court, arguing such calls aim to weaken not only the ICC but also trust in the international justice system.
