Jerusalem Rabbinical Court Grants Father Full Custody Amid Parental Alienation Case
In a significant ruling, the Regional Rabbinical Court in Jerusalem has terminated parental alienation and granted full, exclusive custody of children to their father. The decision was made by presiding judge Rabbi Yitzhak Oshinsky and judges Rabbi Meir Kahn and Rabbi Shimon Levi, following years of severe alienation tactics by the mother. The father was represented by attorney and rabbinical advocate Moshe Leibovitch.
The court's ruling stemmed from the mother's persistent obstruction of the father's contact with the children, despite repeated attempts by the court to facilitate visitation. The mother allegedly made threats and used aggressive language towards the court and the father, declaring the child would no longer go to him. Professional evaluations, including one by a court-appointed psychologist, indicated the mother was intentionally sabotaging joint custody efforts. The psychologist also noted an incident where the mother brought aggressive acquaintances to a professional meeting to intimidate staff. Reports also surfaced that the mother prevented the children from attending school regularly to disrupt their contact with their father.
Attorney Leibovitch presented a case to the court demonstrating that the children's well-being was severely harmed and that diplomatic or financial measures were ineffective against the entrenched parental alienation. The judges were convinced that further delays were unwarranted. In their decision, they stated, "In light of all the above, and especially in light of the above in the mother's last (difficult) message, it is decided to transfer the children's custody from the mother to the father."
The court has directed welfare services to assist in the immediate and smooth transition of custody, expressing confidence that the father will ensure the mother's role in the children's lives is respected. Leibovitch stated that the ruling serves as a clear warning to any parent attempting to erase the other parent from their children's lives, asserting that justice and the children's best interests will ultimately prevail with proper legal representation.
