Rabbi Calls for Release of Soldiers Jailed for Halachic Observance

Rabbi Eliezer Simcha Weiss, a member of the Chief Rabbinate Council, has appealed to the IDF's Chief Rabbi, Eyal Karim, urging him to intervene in the case of several Givati Brigade soldiers who were imprisoned. The soldiers were reportedly jailed after refusing to enter an armored personnel carrier with a female paramedic, citing their adherence to religious law (Halacha).

In his letter, Rabbi Weiss requested the cancellation of the soldiers' jail sentences and the expungement of their disciplinary records. He emphasized that the soldiers, who are students from Hesder Yeshivas (programs combining military service with religious study), acted out of a desire to uphold their religious lifestyle. Rabbi Weiss expressed deep concern over the situation, stating it necessitates clear intervention from the Military Rabbinate.

Rabbi Weiss also addressed the concept of "pikuach nefesh" (saving a life), arguing it should not be used as a blanket excuse for violating religious precepts in situations that could have been avoided through proper planning. He asserted that religious dispensations are intended for genuine emergencies, not for organizational shortcomings that could have been preempted. He stressed the Military Rabbinate's role in supporting religious soldiers, ensuring they can maintain their observance even within the demanding military framework.

He criticized the decision to imprison the soldiers, suggesting that a command and religious solution should have been found to allow them to perform their duties while adhering to their way of life. Rabbi Weiss warned that this incident could negatively impact the IDF's efforts to recruit from the Haredi and yeshiva communities, as it might undermine their trust in the army's commitment to religious observance.

Concluding his appeal, Rabbi Weiss asked Rabbi Karim to work with senior command to cancel the sentences, review the disciplinary records, and clarify to unit rabbis and commanders the distinction between unforeseen operational emergencies and planned missions. He also requested clear support for soldiers seeking to uphold Halacha, assuring them the Military Rabbinate stands with them.
