Tel Aviv Court Rules WhatsApp Group Admins May Be Liable for Defamation Damages

The Tel Aviv Magistrate's Court ruled that WhatsApp group administrators can be held responsible for defamation damages if they are aware of harmful posts in the group and fail to remove them. Judge Yair Delugin ordered three administrators of WhatsApp groups for soldiers from the 9th Battalion of the Yom Kippur War to pay a total of 90,000 shekels in compensation to a soldier who was subjected to a prolonged smear campaign.

According to the ruling, one group member posted dozens of offensive messages against the plaintiff, including severe accusations and derogatory nicknames. The plaintiff requested the group admins to remove the posts and stop the harm, but they did not take sufficient action. The court clarified that group admins are not automatically liable for every post in real time, but liability arises when the admin is aware of the harmful content, receives a clear warning from the victim, and still refrains from acting.

The judgment emphasizes that managing a WhatsApp group is not merely a social or technical role. When serious accusations and systematic harm occur within the group, administrators are required to act proactively or face financial consequences.
