Sheikh Kamal Khatib Sentenced to Nine Months Community Service for Incitement to Terror

Sheikh Kamal Khatib was sentenced on Monday by the Nazareth Magistrate's Court to nine months of community service and fined 15,000 shekels for incitement to terror and violence. The court also imposed a suspended prison sentence of 10 months, valid for three years, to deter him from repeating the offenses. Khatib was convicted about a year ago, with the indictment filed in 2021. While the court rejected the charge of supporting a terrorist organization, it upheld the incitement convictions.

Khatib is a senior figure in the northern branch of the Islamic Movement, which is outlawed in Israel, serving as deputy to Sheikh Raed Salah and holding the Palestinian prisoners portfolio in the High Follow-Up Committee for Arab citizens of Israel. He was arrested by the Shin Bet in 2021 and held in detention for an extended period. His defense team, including attorneys Hassan Jabarin, Omer Khamaisi, and Ramzi Katilat, have consistently argued the indictment is politically motivated and infringes on freedom of expression. They plan to appeal the conviction.

Representatives from the Adalah Legal Center and Al-Mizan Center, who jointly represented Khatib, stated that the court rejected the state's demand for a 40 to 50-month prison term, calling it extreme and disproportionate. They emphasized that the indictment and conviction were unwarranted, as the three publications at issue fall within the scope of freedom of expression for Israel's Arab public.
