Israeli Bar Association Ethics Committee Chair Faces Conflict of Interest Allegations
The Disciplinary Tribunal of the Israeli Bar Association issued a rare and severe critique of the National Ethics Committee's conduct, particularly targeting its chairman, attorney Menachem Mushkovich. The tribunal annulled the disciplinary proceedings against attorney Lior Sandah, citing a fundamental conflict of interest involving Mushkovich. The complaint against Sandah was filed by the Insolvency Commissioner, from whom Mushkovich receives paid appointments as a special manager or trustee in insolvency cases, creating a direct conflict as Mushkovich himself practices in the insolvency field.
The tribunal emphasized that Mushkovich’s dual role compromised the fairness and integrity of the ethics process, stating that his position as committee chair gave him significant influence over the proceedings. Additionally, the tribunal criticized the committee for accepting an anonymous complaint submitted via USB drive, warning that such procedures risk enabling false or malicious accusations without accountability.
Eran Ben Ari, head of the opposition within the Bar Association, attributed responsibility for the problematic appointment to Bar Association head Amit Bechar, noting that Mushkovich’s appointment occurred during Bechar’s unprecedented third term. Ben Ari called for an independent ethics oversight body outside the Bar Association’s control to ensure impartiality.
The Ministry of Justice clarified that while the Insolvency Commissioner filed the complaint, he is not a party to the disciplinary decision and will review the tribunal’s ruling before deciding on further action. The Bar Association has yet to respond publicly. This case raises broader concerns about the credibility and governance of the Bar Association’s ethics enforcement mechanisms.
