Ganei Tikva Municipality Cancels 5 Million Shekel School Furniture Tender Amid Legal Dispute

The Ganei Tikva municipality canceled a 5 million shekel tender for supplying furniture to a local school and instead awarded the contract to a construction contractor who is not a furniture supplier. This decision sparked legal challenges from Z.K. Ayalon Wood Projects, a company that had participated in the tender and claimed its bid was about 35% cheaper than the contractor chosen by the municipality. The construction contractor subcontracted the actual furniture supply to another company, raising further questions about the procurement process.

Z.K. Ayalon filed a petition with the district court, arguing that the tender cancellation was unlawful. The municipality sought to appeal to the Supreme Court against an interim injunction but was denied. Recently, the district court annulled the municipality's decision and ordered the reinitiation of the selection process by a three-member committee appointed by the municipality.

The court instructed the municipality to notify all tender participants that the contract would cover only the furniture needed for the growing middle school division, based on specifications presented in court. The judge emphasized that if the committee chooses not to select the lowest bidder, Z.K. Ayalon, it must conduct a hearing with the company and provide evidence supporting its decision. The ruling also stressed the importance of good faith and cooperation among all parties to complete the process promptly, ensuring the furniture is delivered before the school year starts on September 1.

This case highlights concerns about transparency and proper procedure in municipal procurement, with implications for potential corruption investigations.
