Israeli YouTuber Wins Legal Battle in Australia Over Video Evidence Against Threatening Medical Workers

Israeli YouTuber Max Waifer achieved a significant legal victory in Australia when the New South Wales Court of Appeal overturned a previous ruling, allowing a recorded video call to be used as evidence against two Australian medical workers accused of threatening Israelis. The video, recorded during an online conversation between the two former hospital employees in Sydney, captured them making violent threats toward Israelis. The court ruled this recording can be admitted in their upcoming trial, scheduled to begin at the end of 2026.

The prosecution argued that the recording was made in Israel, where Waifer was located during the call, and therefore did not violate New South Wales privacy laws. They emphasized that without the video, the jury would struggle to grasp the full context, tone, and facial expressions, significantly weakening the case. Conversely, the defense, led by lawyer Peter Lang, contended that part of the recording occurred in Australia since the microphone capturing the audio was inside the hospital.

The defendants, siblings Ahmad Nadir and Sarah Abu Labda, were suspended for two years from Bankstown Hospital. In the video shared by Waifer, Ahmad expressed anger at Waifer's Israeli identity, threatening that he would be killed and go to hell. Sarah shouted that the land belonged to Palestine and not Israel, and both made explicit death threats, with Sarah stating she would not treat Israelis and would kill them.
