Tiffany Scors and Stephen Mills, a white couple from Florida who sued a fertility clinic after giving birth to a baby girl who was not genetically theirs, have now been granted shared custody of the child together with her biological parents. The girl, Shay, was born in April 2025 with darker skin, which raised the couple’s suspicions because both are white.
After the biological parents were located, the court this week issued the custody arrangement. The couple had previously said they felt a moral duty to find Shay’s genetic parents and reunite the child with them if those parents were fit, able and willing to raise her. In April, they said genetic testing had identified the biological parents.
“This closes one chapter in our heartbreaking journey, but it raises new issues that will need to be resolved,” the couple said. “There was only one thing that was certain on the day our daughter was born and remains certain today, we will love this child and always be her parents.” They also said they had developed a deep emotional bond with Shay and that, “We love our daughter more than words can describe.”
Attorney Jack Scarola, who represents Scors and Mills, said their main fear was that the biological parents would appear and demand the baby back. “They fell in love with this child,” he said. “They would have been happy to raise her, but this is someone else’s child, and someone could come at any moment and ask to take her.” The couple also sought to determine whether their own embryos had been mistakenly transferred to another couple in a similar error. In April, the clinic announced it was closing and that another clinic would open at the same location.
