Israeli Supreme Court Questions Authority on Election Reporting Dispute

Justices of Israel's Supreme Court expressed significant doubt regarding the authority of the Central Elections Committee chairman to unilaterally decide on party requests to report real-time voter turnout. The court was hearing a petition from the Likud party challenging a decision by the committee's chairman, Justice (ret.) Salim Joubran, to disallow parties from tracking who had arrived to vote and who had not.

During the hearing, the justices indicated their difficulty with the notion that the chairman alone possessed the power to make such a ruling, leaning towards the Likud's argument that the authority should rest with the entire committee. "The issue of authority is difficult for us," the judges stated, suggesting that the chairman does not have full authority, but rather the entire committee does, echoing a point made by Likud's legal representative. The core of the court's concern appears to be the locus of decision-making power.

The justices also questioned the legal representation in the case, expressing surprise that the State Attorney's office was representing multiple parties with conflicting positions, including the Attorney General, Joubran himself, and the Elections Committee. They noted the apparent contradiction in the State Attorney's office defending opposing viewpoints.

As a potential resolution, the court proposed that the decision be brought before the full Central Elections Committee for deliberation. This is a significant development, as the Likud holds a majority on the committee, which could influence the outcome if the matter proceeds to a vote. The court made it clear that if the committee cannot reach an agreement, the Supreme Court would intervene by issuing an interim order.
