Documenting Apartment Condition Ensures Return of Security Deposit Up to 19,500 Shekels

In Israel, tenants can secure the return of their security deposit, which can reach up to 19,500 shekels for a yearly lease with a monthly rent of 6,500 shekels, by thoroughly documenting the apartment's condition at move-in and move-out. The law permits landlords only three reasons to deduct from the deposit: unpaid rent, tenant-caused damages, and failure to vacate on time. Landlords must notify tenants in advance and allow time for repairs before deductions.

Tenants are advised to record a continuous video walkthrough of the apartment before moving in, capturing all surfaces and fixtures, alongside detailed photos of any existing defects. Additionally, photographing the electricity, water, and gas meters on the move-in day, and signing a delivery document listing keys and appliances, are crucial steps. This documentation serves as dated evidence to resolve disputes, as memories of damages over years can conflict.

Upon moving out, tenants should repeat the process with a video of the empty apartment, meter readings, and key counts, obtaining written confirmation from the landlord that the apartment was returned. The landlord then has 60 days to return the remaining deposit. Any profits earned from the deposit if held in a savings account must also be returned to the tenant.

Disputes often arise over cleaning and repairs. For example, a deduction of 4,200 shekels might include 1,800 for painting, 1,500 for replacing a cabinet door, and 900 for cleaning. However, normal wear and tear, such as faded paint after three years, is not deductible. Proper documentation can reduce or eliminate unjustified deductions. Forced eviction is illegal without a court order.
