Tel Aviv Court Awards Over 4 Million Shekels to Motorcyclist Severely Injured Crossing Red Light

The Tel Aviv District Court has ordered the insurance company "Hapol" to pay more than 4.1 million shekels in compensation to a young motorcyclist severely injured in a traffic accident after crossing a red light at high speed. The accident occurred in March 2023 and left the plaintiff, born in 1987, with multiple severe injuries following a violent collision with a vehicle. Medical experts appointed by the court assessed his overall disability at 76.27%, including complete paralysis and minimal function in his left hand, a condition equated by the judge to an arm amputation accompanied by unbearable phantom pain.

Judge Orly Mor-El emphasized the plaintiff's drastic change from an independent, active individual to someone fully dependent on others for basic daily activities. During the trial, the insurance company contested the extent of the plaintiff's disability, alleging pre-existing functional instability and seeking to reduce the compensation. However, the court rejected these claims, confirmed a 75% functional disability, and based the compensation calculation on a monthly salary of 10,000 shekels.

The comprehensive ruling covers significant damages for loss of earning capacity, past and future third-party assistance, extensive medical expenses including medical cannabis, and mobility allowances. After deducting National Insurance Institute benefits of approximately 2.42 million shekels, the net compensation remains substantial. This case highlights the severe consequences of a momentary lapse in road safety and adds to a series of dramatic rulings in medical compensation for traffic accident victims, underscoring the critical importance of personal responsibility on the roads.
