Israeli Accountants Challenge Justice Ministry Over Trustee Appointment Rules

The Israeli Institute of Certified Public Accountants has filed a petition with the Supreme Court against Justice Minister Yariv Levin and the Insolvency Commissioner. The petition argues that the current regulations for appointing trustees in corporate insolvency cases unfairly discriminate against accountants compared to lawyers. Specifically, the threshold criteria require three years of insolvency experience, which accountants claim excludes them despite their professional qualifications and relevant expertise.

The accountants contend that while lawyers’ legal representation experience is recognized, accountants’ professional experience is disregarded, creating an unjust barrier to entry and infringing on their freedom to practice. They are seeking an interim injunction to freeze the trustee appointment committee’s work until a final ruling is made.

Prior to the petition, the Institute’s president, Chen Schreiber, attempted to negotiate with the Justice Ministry to amend the regulations but was unsuccessful, prompting the legal challenge. The dispute centers on equal opportunity for qualified accountants to join the trustee registry that handles corporate insolvency and economic rehabilitation processes.

The petition highlights the imbalance in recognizing professional experience and calls for regulatory changes to ensure fair treatment between lawyers and accountants in this critical economic role.
