KSP Ordered to Pay 110,000 Shekels After Forcibly Dragging Customer Out of Eilat Store
A Haifa Magistrate's Court recently ruled that the KSP electronics chain must compensate a customer approximately 110,000 shekels after he was forcibly dragged out of the Eilat branch by the store manager. The court held both the company and the manager jointly and severally liable for the incident, which occurred in June 2021.
The 38-year-old plaintiff had come to the Eilat store after his wife was refused service for not presenting an ID. He showed his own ID and demanded service without further waiting, while verbally confronting the manager, filming him, and calling the police. In response, the store manager grabbed the customer by the neck, pushed him forcefully outside the store, and threw him to the ground.
Video evidence showed the manager holding the customer down for about 13 seconds before returning inside without looking back. The plaintiff described the event as a violent and bullying assault involving excessive force. He filed a lawsuit about six months later, alleging negligence and assault by KSP and the manager.
The defendants claimed the customer behaved aggressively, threatening staff and forcing the manager to remove him in self-defense. However, Judge Hadar Masouri rejected this defense, stating that even if the customer had threatened the manager, it did not justify the brutal physical response. The judge noted the manager initiated the physical contact and dragged the customer several meters before throwing him down.
The court found the manager’s actions constituted assault and negligence, causing foreseeable harm. It also assigned 10% contributory negligence to the customer for his aggressive behavior and refusal to leave when asked. The compensation included 90,000 shekels for damages plus 18,500 shekels for legal fees, to be paid jointly and severally by KSP and the manager.
The ruling emphasized that anger does not justify shouting at staff or refusing to comply with requests, and recommended using official complaint channels instead of confrontation.
