Haifa Family Court Rules on Inheritance Dispute Between Deceased's Children and Nephews

This month, the Haifa Family Court resolved a long-standing inheritance dispute involving the heirs of a woman who passed away in 2016. The deceased left behind a property portfolio including a store and two merged apartments, which she bequeathed to her six children and the children of her deceased daughter, dividing the estate into seven equal shares. Despite this, the heirs had not yet executed the inheritance and were engaged in legal disputes over the estate.

In 2021, a prior dispute was settled with a court-issued inheritance order and an agreement on how to divide the property. However, the nephews, children of the deceased’s sister, refused to comply, alleging they were misled about the property valuation method, specifically the use of "Standard 19," a valuation standard commonly used by banks for credit collateral. They argued this standard undervalued the properties compared to free market prices and thus violated their rights.

The deceased’s children filed a lawsuit to enforce the agreement and dissolve the joint ownership, claiming damages of 100,000 shekels. The court ruled in their favor, ordering the nephews to honor the agreement based on the appraisals, which valued the store at 985,000 shekels and each apartment at 815,000 shekels. The court found no evidence supporting the nephews’ claim of a significant discrepancy between the appraisals and market values. It also noted that the nephews’ representative, a certified accountant, had signed the agreement after receiving a reasonable explanation from her attorney.

The nephews were ordered to pay 15,000 shekels in legal costs. Attorney Ran Fingerer, representing the deceased’s children, emphasized the ruling’s importance in clarifying heirs’ rights and obligations through transparent agreements. Attorney Tal Itkin represented the nephews.
