Israeli Competition Authority Considers Over 17 Million Shekel Fine Against Samsung Importer for Undermining Parallel Imports

The Israeli Competition Authority has informed Sunny Communications, the official importer of Samsung products in Israel, that it is considering imposing a financial penalty exceeding 17 million shekels. This action follows suspicions that Sunny violated competition laws by harming parallel imports through pricing and market interference.

According to the Authority, Sunny complained to Samsung's Korean parent company about parallel imports of Samsung mobile phones entering Israel from the Palestinian Authority territories. The parallel importer presented itself as an authorized Samsung dealer, offering customers warranty and service through official Samsung service centers. Sunny alleged that the parallel importer sold better-quality devices at lower prices than those Sunny marketed and requested Samsung to "resolve the issue" by delineating territorial sales rights and ceasing sales to the Palestinian Authority.

The Competition Authority noted that since a legal amendment took effect in September 2023, direct importers like Sunny are prohibited from actions that could harm parallel or personal imports. This includes sharing information with manufacturers that could track supply chains to suppress competition. Sunny's case is the fourth enforcement proceeding initiated by the Authority under this amendment, which targets anti-competitive behavior by major direct importers across various sectors.

Sunny Communications has the right to present its arguments before the Competition Authority finalizes any penalty. The Authority's ongoing enforcement reflects its intensified efforts to protect parallel importers and maintain market competition in Israel.
