Israeli Court Orders Harel Insurance to Compensate Customer After False Car Theft Fraud Claim

The Netanya Magistrate's Court ruled that Harel Insurance must compensate a customer approximately 55,000 shekels for her stolen 2016 Kia Sportage, plus 18,500 shekels in legal fees, after rejecting the insurer's claim that she staged the theft. The incident occurred in February 2024 when the insured reported her car stolen in the West Bank area following a warning light that appeared on the vehicle. The customer, represented by attorney Uri Bechar, cooperated fully with the insurer and filed a police report on the theft.

Harel Insurance denied the claim, alleging the customer had a motive to dispose of the car due to recurring technical issues and fabricated the theft to receive insurance compensation. However, Judge Hilmi Hajooj found no evidence supporting the insurer's fraud allegations in the investigation reports. The court noted the vehicle had undergone recent maintenance in September 2023 and that the warning light was not an unusual fault justifying the theft claim.

The judge emphasized that the insurer failed to prove any connection between the car's technical problems and the theft event. Testimony from a garage representative confirmed that stopping the car after the warning light appeared was standard procedure, which the insured followed. Attorney Bechar stated the ruling underscores that insurance fraud claims require solid evidence rather than mere suspicion, and without such proof, the insured's claim must be honored.
