Court Rejects Lawsuit Against Bar Association, Criticizes Plaintiffs

The Tel Aviv District Court on Wednesday dismissed a lawsuit filed by attorneys Eran Ben Ari and Yitzhak Netovitch against the Israel Bar Association. The court sharply criticized the plaintiffs' conduct, ruling that they had presented a "partial and distorted picture" to the court and acted in bad faith, constituting an abuse of the legal process.

Ben Ari and Netovitch, who are vocal opponents of Bar Association head Amit Bachar, had petitioned the court alleging the association misused its resources to promote controversial causes, including the protest against the government's judicial overhaul. However, the court found that the plaintiffs failed to disclose crucial information, specifically that the actions they complained about had been approved by votes within the Bar Association's National Council, of which they are both members.

Presiding Judge Nimrod Flexer stated in his ruling that Ben Ari and Netovitch did not reveal to the court that the actions they challenged were approved by the National Council. He further noted that the plaintiffs had also omitted that they were parties to other petitions concerning the same issues, thereby presenting an "ambiguous and partial" picture that created a distorted reality.

The court ordered Ben Ari and Netovitch to pay 10,000 shekels in legal costs. Judge Flexer emphasized that their conduct went beyond a minor omission, directly linking it to the duty of disclosure required of petitioners in administrative proceedings. He wrote that the plaintiffs violated their disclosure obligations, demonstrating "genuine bad faith" and an abuse of the legal process.

The ruling places Ben Ari, who is also a candidate for the Knesset associated with the "Am Israel" party, under significant judicial scrutiny. Netovitch also faced similar criticism for failing to disclose relevant details and for presenting a partial account of the events that formed the basis of their petition.
